End User License Agreement (EULA)
Effective Date: June 24, 2026

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Polygon Sunshine LLC ("Company," "we," "us," or "our") for the virtual reality flying combat video game Homeland Defender ("Game").

By downloading, installing, or playing the Game via Meta Quest, Steam, or any other authorized platform, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or play the Game.

1. License Grant

* Limited License: We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to download, install, and play one copy of the Game for your personal, non-commercial entertainment.
* Platform Terms: This license is conditioned upon your compliance with the respective terms of service of the platform you used to purchase or download the Game, including the [Meta Terms of Service](https://www.meta.com/legal/quest/terms-of-service/) and the [Steam Subscriber Agreement](https://store.steampowered.com/privacy_agreement/).

2. License Restrictions
You agree not to, and will not permit others to:

* Commercial Use: Exploit the Game, or any of its parts, for any commercial purpose without our express written consent.
* Reverse Engineering: Copy, decompile, reverse engineer, disassemble, derive source code from, or modify the Game.
* Cheating and Hacking: Create, use, or distribute cheats, automation software (bots), hacks, mods, or any unauthorized third-party software designed to modify the Game experience.
* Distribution: Sell, rent, lease, license, distribute, or otherwise transfer the Game or any copies of it to any third party.

3. Intellectual Property Ownership

* Our Rights: The Game, including all code, graphics, audio, gameplay mechanics, titles, and themes, is the sole property of Polygon Sunshine LLC and is protected by copyright, trademark, and other intellectual property laws.
* No Transfer: This Agreement does not grant you any ownership rights in the Game. All rights not expressly granted to you are reserved by Polygon Sunshine LLC.

4. Privacy and Data Usage

* Privacy Policy Integration: Your privacy is important to us. Our data practices are governed by our Privacy Policy.
* No Personal Data: We do not collect, store, or share your personal data.
* Aggregate Data: As detailed in our Privacy Policy, non-identifiable, aggregate technical data (such as crash logs, performance metrics, and hardware configurations) may be collected automatically by underlying systems or platforms solely to help us stabilize and optimize the Game.

5. Termination

* Our Right to Terminate: This Agreement is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any terms of this Agreement.
* Your Right to Terminate: You may terminate this Agreement at any time by permanently deleting and destroying all copies of the Game in your possession.
* Effects of Termination: Upon termination, you must cease all use of the Game and destroy all copies.

6. Disclaimer of Warranties & Limitation of Liability

* As-Is Basis: To the maximum extent permitted by applicable law, the Game is provided to you "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind.
* Limitation of Liability: In no event shall Polygon Sunshine LLC be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of your use of or inability to use the Game, even if we have been advised of the possibility of such damages.

7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Polygon Sunshine LLC is legally registered, without regard to its conflict of law principles.
